Recently, we had a debate in class regarding the validty of the formation of jirgas in the country, that whether these judicial houses should stand or not ? I personally condemned these jirgas and stood up against them in class and in blog posts too. Yes, I said that these jirgas are wrong and there formation and justice system is null and void but now after different views and researches, I personally think that these jirgas are not that bad.
Justice delayed is justice denied. In Pakistan, unfortunately the judicial system is flawed and is unable to provide people with justice. Through-out the history, the judicial system has shown deficiencies in making crucial verdicts. Cases do not get heard and files remain in shelves, full of dust. There are various reasons due to which the judiciary is unable to perform up to the mark. Judges are scared of making decisions especially in controversial cases and fear the backlash of people. People who have power, do not follow laws and think they are above board. Along with these, bribery and different corruptions are a part of the judicial system.
People do not get justice and especially the poor and the weak. They have totally lost their trust in the judicial system and in these conditions, the only door which they can bang is the door of jirgas and panchayets. These places (whatsoever is their merit of making a decision) listen to the cases of these people and take swift actions. These places are not officially courts but unfortunately play the role of courts.
I would like to deviate from my previous statements because if I put myself into the shoes of those wretched and devastated people, I might come to know, what is their condition and how cruicial is a jirga for them. Jirgas are their last hopes and they have to go to them willingly or unwillingly. It is better for us that we should not criticize them and consider them as a helping hand. Along with this, we should still try to make our judicial system better so that these debates do not arise.
