The inefficient
and unproductive practices of the judiciary in Pakistan made me believe that
the country was in need of another system that could resolve all the prevalent
issues. However, after the thoughtful discussions in class, I have come to
believe that this may not be a viable option.
Putting up
an entirely new justice system would be impractical and costly. Though it would
create new jobs but there is a greater chance that the existing people would
not be entirely compensated. Moreover, it is uncertain that it would work as
there is a greater probability that the new system would reach the same fate as
the existing one; failing to deliver justice. On the contrary, the current judicial
system has in effect worked in some countries proving that with slight
modifications, it can operate in Pakistan as well. Furthermore, another system
would open the floodgate for people to establish their own justice systems,
like the jirga system in rural areas, acting as a token to retaliate against
the government in any way possible. Perhaps, current judicial system is the
best the country has.
By reviewing
the system, the branch can be improved to work efficiently. Current cases
should be resolved as soon as possible and trained officials should be
appointed to prevent the formation of backlog in future. Also, more resources
should be diverted to coach the officials in the basic know-how of the system.
In a
nutshell, instead of a making a new justice system, the existing one should be
improved to cover for the present loopholes.
