Session 11: Judiciary and Politics

Session 11 
The 2009 Movement to restore the Judiciary of Pakistan led by Nawaz Sharif was the reason why Chief Justice Iftiqar Muhammad Chaudary was restored to his original position. He was suspended by the military supreme leader “General Pervaiz Musharraf” who was at the time running a coup on the country. The suspension was followed after concerns shown by Musharraf on some cases that were open evidence against the rule of General Musharraf in the country.  


Both the suspension and restoration were political moves by the two leaders. Musharraf wanted to extend his rule and thus, removed the biggest hurdle in his way. Nawaz, who came back after a long exile from the country, wanted to regain his popularity that he had lost by staying away from the country for over eight years. He used the restoration of the judiciary as the perfect way to do so.  It is funny how we believe that the judiciary is independent and free from politics, however, it remains to be the center of attention for the political arena.

I agree with what you've said, Rauf. The judiciary cannot serve its purpose unless and until it is removed from the influence of the executive or politicians. One cannot expect them to make an unbiased decision considering what the current situation in our country is.

I agree with the fact that its merely our believe that judiciary works independently,but we should also not forget the fact that they are also normal human beings like us.
They also have their biases or at least a soft corner for one political party or an other. There are also some restraints that acts as a hurdle in independent and apolitical judiciaries to act accordingly.
