The judiciary, I believe, is one of the most integral pillars of the State. Where the State lays down the framework and mechanism of how matters will continue and operate, the judiciary plays an important role in ensuring that the 'law' is implemented and present. Any regime, I believe, can never manufacture absolute consent and therefore, needs to manage the ones who disagree in one way or another. For example, the Taliban in Afghanistan demanded, with their stick, for everyone to agree upon their version of the Shariah during their government, and if some fraction didn't, they were persecuted. i.e Hazaras. Much like "Follow us and its good, don't and the sticks right up yours!"
Without the judiciary and its stick, it seems probable that the law is only word. The law, like money, only carries its value because it is given so. The law is sacred and must therefore be respected; but if it isn't, will the law remain as important as it seems to be?
We have studied the ideas of men like Locke and Aristotle who seem to be of the thought that the presence of a mechanism needs to be in place in order to prevent anarchy and utter chaos.
Now, a thought has occurred to me. I have tried for a long time to find an example of a functioning government or society which operates without most of the core elements of the state. Sure, going back in history wouldn't be a grand idea as many may claim that times have changed. But how about the community that we have built on the internet? Daily, billions of people communicate and interact with another often doing transactions. They don't need a passport to talk to someone, nor are there any boundaries or continents. There is no police nor a judiciary. No government exists to tax us. No Putin jails Navalny for protesting. Big companies like amazon and ebay earn billions off it, and they don't build a jail out of your money to punish any debtors, they factor the rogues out of their system through design. There aren't any laws yet people, contradictory to Locke's views, communicate humanely. This interaction and trade, regardless of the fact that it is not completely identical to our society and its intricacies, should atleast make us question Locke's ideas and critique the overrated essence of the the State and its artillery,

I'm not sure if this is going to sound correct but I happen to think that Hobbes' belief that humans are 'necessarily and exclusively self-interested' would explain the civilized behaviour of the community on the internet. This basically means that humans only adopt an orderly sort of behaviour on the internet because they know that its use is going to prove beneficial for them.
