Judicial system of Pakistan


     In Pakistan pursuing justice from court of law has become expensive and hard to get, When the people to whom injustice is done are in pursuit of seeking justice, they face hardship in the process. Generally the entire process of the so called justice trail and courts of justice at different level appear to have badly influenced. Politicians, officers, businessmen, influential people such as landlords prove as an obstacle in way to independent and unbiased justice system. In the process, naturally the distressed party suffers injustice. Unfortunately in such scenario at both upper and lower levels the ultimate decisions are affected, indicating lack of independence of the judicial system in Pakistan.
     So the main question is what are the major reasons behind the failure of the judiciary? Firstly, the frequent military rule proves to be an obstacle for Pakistan to enjoy the perks of being complete democratic state, hindering the judiciary to carry out its role independently. Other reasons which contribute to the weakness of judicial system in Pakistan are the lack of merit based independent, deserving judges and also the lack of check and balances.

I think the deterrent factor in the supremacy of Judicial system is its limitations as it is only equipped with power to interpret laws, not to change their innate and integral meanings.This allows constitutional amendments to surpass court rulings. Which is also evident in the Pervez Musharraf's 17th amendment case.
