Session 5- One Social Contract Theory

What’s fascinating about travelling is to get to know how people perceive things in different parts of the world. Because they are brought up in different environments, they tend to see things from different perspectives. Some prefer wearing kamez shalwar while others prefer wearing pant shirts. Let me put it in our class context, some go for Jirgah system while others go for the Judiciary and the State; it entirely depends upon their preferences and mentality. 

Therefore, we can also conclude that the modern social contract theories that are developed by multiple classes are all justified in their places. Political Liberalism is a valid matter. But it’s a pity that almost all of these social contract theories somehow fail to fulfill their claim because Injustices prevail in them. They prevail because these theories are incomplete.

Why jirgah preferred by some people is because they believe it’s better in some aspects. The question that needs to be answered is how can we come up with a social contract theory that satisfies all these perspectives and aspects fully? We need to address them individually and try to bring them under one umbrella instead of debating over which one is right or wrong.


Our Prophet has laid great benchmarks and examples for us which unfortunately we seldom utilize.

If these theories fail because they are incomplete, how can they be completed to make them work in practice?

Sir since there are so many courts, with so many different laws, working to give justice to people. That it is almost impossible to bring them together because there are pros and cons of every one of them. But i guess if we make amendments and develop the jirga system properly, and set it as a benchmark, we really can make a difference. At least on paper even if our corrupt politicians and judiciary does not take advantage of it.

Besides, you will wonder why am I bragging about Jirga System so much. Well I consider it better than the others because it resembles the way our Prophet used to give justice.
