Session 11: Constitution and it's ammendments

It took Pakistan nearly nine years to publish and implement its first written constitution. The first constitution of Pakistan was implemented in 1956, which since then has been subject to constant changes and up degradation. Constitution is basically a frame work under which government and political activity is conducted. These are the set of rules and regulations that govern the government itself. It is usually considered to be an eternal source of law that cannot be changed until majority of people in the senate and national assembly has voted for it, and stands over all political forces and complexities.

No dictator has the authority to change the constitution and it needs to be protected but things have worked out quite differently especially when it comes to Pakistan. 21 amendments have taken place in a history of 67 years and constitution has been reconstructed thrice. Surprisingly all new constitutions have been written and compiled under the rule of dictators, which clearly shows that how vulnerable these constitutions have been in front of the military dictators who changed the constitutions according to their own benefits and biases.

Ignoring the number of blunders that different governments have made in amending the constitution, one thing that should be kept in mind is that writing a constitution on which all people unanimously agree is an extremely difficult task. A clear example can be seen from the practical example that was done in class regarding formation of ten points of the constitution. One hell of havoc was created when the final ten points were jotted down on the board, with one of the most shocking point which said that education should be done according to the principles of Islam and Sharia. The most alarming point was that not only were these points given but they were also approved by the majority of the class. This example clearly showed that although there were different views of people who voted in favor of this constitution, but because of their political affiliations with their parties and loyalty towards their leaders they were obliged to follow the command of their leaders.

It won’t be wrong to say that no country in the world has a perfect and flawless constitution. Inaccuracies, distortions, omissions are part of almost all constitutions but the thing that should be concentrated is that no dictator should be given the authority to mold and change the constitution according to his own will. A fair and impartial constitution should be made in which rights of general public should be guaranteed and justice should be given to all the people living in the country regardless of the total wealth or backing that they have.

  1. Habib - The constitution has played an important role in the politics of Pakistan which is why the points that you have mentioned are very important.
    Several countries around the world hold a special reverence towards their constitution and consider it to be a holy stone in the foundation of their country, the most prominent example of this the U.S. Do you think that this sort of respect for the constitution is present in Pakistan? If not, then why so and also, could this possibly be the reason why over the years dictators have been so easily able to amend it at their will?
    Looking in to these causes may be interesting and my shed more light upon the crucial points that you have made!
